Welcome to Chika With Me ("Chika With Me", "we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of the website at chikawithme.com and the Chika With Me learning application (together, the "Service"). By creating an account, ticking the "I agree" box, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use Chika With Me
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or guardian. By using the Service you confirm that the information you give us is accurate and that you are allowed to agree to these Terms.
2. Your account
You are responsible for keeping your login details secure and for everything that happens under your account. Please use a strong, unique password and let us know promptly if you believe your account has been accessed without permission. Do not share your account, and do not create an account using someone else's identity.
3. The Service
Chika With Me helps you learn Cebuano (Bisaya) through vocabulary, native-speaker audio, quizzes and progress tracking. The Service is currently provided free of charge. We may add, change, limit or discontinue features at any time, and we do not guarantee that the Service will always be available or uninterrupted.
4. Our content and intellectual property
All content made available through the Service — including the vocabulary lists and translations, the audio recordings, text, images, graphics, the Chika With Me name and logo, the page designs, and the underlying software — is owned by Chika With Me or its licensors and is protected by copyright and other intellectual-property laws. We have invested significant time and money, including paying native speakers to record and proof-check the audio. Nothing in these Terms transfers any ownership of that content to you.
5. Your licence to use it
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own personal, non-commercial language learning only. This licence exists only while you comply with these Terms.
6. What you must not do
To protect the work that goes into Chika With Me, you agree that you will not, whether yourself or through anyone else:
- copy, reproduce, download, record, screen-capture, scrape, harvest, republish, distribute, sell, sub-licence, rent or otherwise share any of our content, including the audio recordings and vocabulary data, except for the ordinary personal use the Service is designed for;
- use any automated means (bots, crawlers, scrapers, scripts) to access, index or extract content, or extract content in bulk;
- create any derivative works from our content, or use it to build, train, improve or populate another product, dataset, model or service — including any product that competes with Chika With Me;
- use our content for any commercial purpose, or make it available to the public in any form;
- remove, obscure or alter any copyright, trademark or other proprietary notices;
- reverse engineer, decompile or attempt to extract the source code of the Service, except to the limited extent the law expressly permits;
- interfere with, disrupt, probe or attempt to gain unauthorised access to the Service, its servers, or other users' accounts or data;
- use the Service for anything unlawful, harmful, deceptive, abusive or infringing.
Any use of our content not expressly permitted by these Terms is prohibited and may infringe our rights.
7. Content you create
If the Service lets you create your own content (such as personal notes), you keep ownership of what you make. You grant us a licence to store and process that content only as needed to operate the Service for you. You are responsible for your own content and must not store anything unlawful or infringing.
8. Privacy
We take your privacy seriously. We collect only what we need to run the Service — such as your name, email address and a securely hashed password — and we do not sell your personal information. We will handle your data in line with applicable privacy laws. If you would like your account and data deleted, contact us at the address below.
9. Disclaimers
Chika With Me is a learning aid provided on an "as is" and "as available" basis. While we work hard to keep the content accurate and natural, we do not warrant that it is complete, error-free, or suitable for any particular purpose, and the Service is not a substitute for professional translation or interpretation.
10. Limitation of liability
To the maximum extent permitted by law, Chika With Me will not be liable for any indirect, incidental or consequential loss arising from your use of (or inability to use) the Service. Nothing in these Terms limits any rights you have under consumer law that cannot lawfully be excluded.
11. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service. Sections that by their nature should survive termination (including sections 4, 6, 9 and 10) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the version and effective date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state, without affecting any mandatory consumer protections in your own country.
